Terms of Use
These terms apply to the PhotoChopper iPhone app (“PhotoChopper” or “the app”), made by George Tevosov (“we”, “us”). By downloading or using the app you agree to them. If you don’t agree, please don’t use the app.
1. Licence
The app is licensed to you, not sold, under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms add to the Standard EULA; if the two conflict, the Standard EULA wins on the licence itself. Apple is not responsible for the app or its support, but Apple and its subsidiaries are third-party beneficiaries of the Standard EULA and may enforce it.
2. Your photos and deletions
- PhotoChopper helps you decide what to keep and what to delete. You decide what to delete, and you are responsible for those decisions.
- The app deletes photos through Apple’s Photos framework. iOS asks you to confirm, and deleted items go to Recently Deleted in the Photos app, where they can usually be recovered for about 30 days. After that, or if you empty Recently Deleted, they are gone for good. With iCloud Photos, a deletion applies to all your devices that use the same library.
- Suggestions such as “bad photos”, “similar”, “best pick” and categories are made automatically on your device and can be wrong. Please look before you chop.
- Keep a backup of photos that matter to you. We are not liable for photos you delete, or for data lost through iOS, iCloud or your device.
3. Acceptable use
Use the app only on photos you have the right to manage, and only in line with the law and the App Store terms. Don’t reverse engineer, resell or misuse the app except where the law allows it.
4. Subscriptions
PhotoChopper is free to download. It also offers an optional auto-renewable subscription, with monthly and yearly options:
- The price, the length of each subscription period and what the subscription includes are shown in the app before you buy. Prices may vary by country and are set in the App Store.
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the current period ends. Your Apple Account is charged for the renewal within the 24 hours before the current period ends, at the price shown in the App Store.
- You can manage or cancel your subscription in iOS Settings → your name (Apple Account) → Subscriptions, or in the App Store. Cancelling stops the next renewal; you keep access until the end of the period you have paid for.
- If a free trial is offered, any unused part of the trial is forfeited when you buy a subscription. If you don’t cancel at least 24 hours before the trial ends, the subscription starts and you are charged.
- Payments and refunds are handled by Apple under its terms; to request a refund, go to reportaproblem.apple.com. We cannot issue refunds ourselves.
5. Privacy
Your photos are analysed on your device. How we handle the limited data we do collect is described in our Privacy Policy.
6. Third-party services
The app relies on Apple’s iOS, Photos and iCloud services, and on Google Firebase for anonymous analytics and crash reports. Those services have their own terms, and we are not responsible for them.
7. No warranty
The app is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. We don’t promise that the app will be error-free, uninterrupted, or that its suggestions will be accurate. Some countries don’t allow these exclusions, so parts of this section may not apply to you.
8. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data (including photos), profits or goodwill, arising from your use of the app. Our total liability for any claim is limited to the amount you paid for the app or subscriptions in the 12 months before the claim, or USD 10 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
9. Changes and ending
We may update the app or these terms. If we change the terms, we will post the new version here with a new effective date; continuing to use the app means you accept them. You can stop using the app at any time by deleting it.
10. Governing law
These terms are governed by the laws that apply where the developer is based, without regard to conflict-of-law rules, except where the consumer protection laws of your country of residence give you rights that cannot be waived.
